Sad truth today: “How much justice can you afford?”

“Appeals?” I remember those:

ALL judges know what almost ALL lawyers know — that almost ALL lawyers will accept the Judge’s ruling on a legal motion regardless of its merit, and will never take that ruling up on appeal. And why won’t they appeal the Judge, no matter how wrong the ruling? “It’s the Benjamin’s,” as some clients will say, i.e., the money, pure and simple. “Money talks.” The clients won’t find the money to fund the “filing fee” for the appeal, let alone the lawyer’s fee for the appeal. Few clients have the money to appeal the judge, and even those with enough money, value their money more than their liberty. All the courthouse players know this. The absence of money lends more power to the Judge, and of course we all know the saying, “power corrupts, and absolute power corrupts absolutely.”

Knowing this, most Judge’s will simply go with their instincts and personal preferences when ruling on the lawyer’s motion, rather than researching or checking on the latest applicable case law. They don’t worry about being “reversed” anymore “on appeal,” since they know that almost NO lawyer will make the effort to appeal them anymore. Appeals happened more in the old days when money didn’t dictate as much as integrity and principal. Today, most judges and lawyers know that the almighty dollar “rules” at the end of the “ruling,” more than the merits of any judicial decision. The only exception: Public Defender cases involving the indigent, since YOU, the taxpayer, are funding all the appeals! Sad or not, this is reality today — and all the judges and lawyers know it — and now you do too.
